Terms of Use for the KIKASETE App

These terms and conditions (hereinafter referred to as "these terms and conditions") govern how you use the services related to the application software "KIKASETE®" (hereinafter referred to as "this app") provided by Kids Scope Co., Ltd. (hereinafter referred to as "our company"). Please use this service only after agreeing to these terms and conditions.

    3. "Content" refers collectively to text, sound, still images, videos, software programs, code, etc. provided on the Service, including text, sound, and other information posted by users.

    3. If you are a minor, please use this service only with the consent of your legal guardian or other legal representative.
    4. If a minor user uses the Service by falsely claiming to have consent from a legal guardian when they do not, or falsely representing themselves as an adult, or if they use other fraudulent means to make others believe that they are legally competent to act, any legal acts relating to the Service cannot be revoked.
    5. If a User who was a minor at the time of agreeing to these Terms and Conditions uses the Service after reaching the age of majority, the User will be deemed to have ratified all legal acts related to the Service.

  • Article 4 Purpose of use

    1. The Company provides the Service solely for the purpose of personal and non-commercial use by Users. Users may use the Service in accordance with the provisions of these Terms and Conditions to the extent that it does not conflict with this purpose.
    2. Regardless of the purpose, Users may not lend, transfer, change the name of, buy, sell, lease or sublicense the rights or accounts granted to them for use of the Service to a third party, or derive income from the use or provision of the Service.
  • Article 5 User Registration

    1. Users shall, at their own responsibility and expense, prepare the environment necessary to use the Service (hereinafter referred to as the "Usage Environment"), including smartphones or other information devices, internet connection lines, telephone lines, and security measures.
    2. When registering as a user, the user must accurately enter the information required for registration, including information about the user and their child. The Company will not accept registration by a proxy of the user unless the user is a minor.
    3. We shall not be liable for any damages incurred by a user if the user registers information of someone other than the user himself/herself or if we determine that the user has registered using fraudulent means.
    4. Anyone who wishes to use this service will become a registered user upon agreeing to these terms and conditions and completing user registration.
    5. If you have previously had your account deleted due to a violation of these Terms or other terms of use, we may be unable to register as a user at our discretion.
    6. The Company will grant an account to registered users only under these Terms and Conditions and any other terms of use separately stipulated by the Company as necessary.
  • Article 6: Usage and Account Management

    1. We will grant an account to registered users who have completed user registration. Users are responsible for keeping their account and registration information (including email address, date of birth, and password) safe. We shall not be liable for any disadvantages or damages suffered by users due to inaccurate or false registration information.
    2. Even if someone other than the user uses the account due to theft, fraudulent use, or other circumstances of registered information, the Company shall not be liable for any damages incurred by such use unless the Company is at fault. If the Company or a third party incurs damages due to the fraudulent use of registered information or the account, the user shall compensate the Company and the third party for such damages.
    3. If the Service is used under a Registered User's account, the Company may treat the use as having been made by the person who registered as the user, and all consequences and responsibilities arising from such use shall belong to the Registered User.
    4. Users understand that internet communication charges may apply.
    5. Users agree that as a result of their use of the Service, their or their child's voice may be recorded in order to improve the Service. Please also refer to our Privacy Policy.
    6. The Company provides this service using SSL encryption. Users agree to this level of security.
  • Article 7 Handling of Personal Information, etc.

    Personal information and registration information will be handled appropriately in accordance with the privacy policy separately established by our company.

  • Article 8 Advertising

    The Company may post advertisements for the Company or third parties on the Service.

  • Article 9 Prohibited acts

    When using this service, we prohibit users from engaging in the following acts. If we determine that a user has violated any of the prohibited acts, we may suspend use, delete the user's account, or take any other measures we deem necessary.

    1. Any act that infringes the intellectual property rights of our company or a third party.
    2. Any act that damages the reputation of our company or a third party
    3. Any act that infringes on the assets of our company or a third party or the credibility of this service
    4. Use of computer viruses or harmful programs or acts that induce them
    5. Any act that places an excessive burden on the infrastructure facilities for this service.
    6. Attacks on the servers, systems, or security of this site
    7. Actions that are contrary to public order and morals, or that may be contrary to public order and morals
    8. Attempting to access the Service by any means other than the interface provided by our company
    9. Any other act that the Company deems inappropriate
  • Article 10 Suspension of Service Provision

    1. The Company may, at any time and at its discretion, without notice to Users, suspend provision of all or part of the Service to all or some Users, delete their accounts, or refuse their re-registration. Furthermore, if the Company requests Users to stop using the Service, the Users shall immediately stop using the Service.

    4. Users may not sell, edit, process, adapt or otherwise modify, redistribute, sublicense or transfer all or part of the Service and our intellectual property rights, etc.
    5. The Company grants Users permission to use the Company's company name and service name marks, logos, and images (hereinafter referred to as "Company Credits") within the scope specified in these Terms and Conditions and separately established guidelines.
    6. Users may not remove, alter, tamper with, or make any other changes to the appearance of any of the elements of our credits (including HTML source) in whole or in part.
    7. Users may not use our credits in a manner that tarnishes our image, gives the impression that there is some kind of partnership between us and the user, or causes confusion that the services provided by us and the user are the same service.
  • Article 12 Disclaimer

    1. We shall not be liable for any damages incurred as a result of changes to, interruptions to, or termination of the content of this service.
    2. The Company shall not be involved in or bear any responsibility for the User's environment for using the Service.
    3. The Service and the App are provided "as is" and at the User's risk. The Company makes no guarantee that the Service will meet the User's specific purpose, that it has the expected functionality, commercial value, accuracy, or usefulness, that the User's use of the Service will comply with applicable laws and regulations or internal rules of industry organizations, or that there will be no defects.
    4. The Company does not guarantee that the Service is compatible with all information terminals, and Users acknowledge in advance that malfunctions in the operation of the Service may occur due to updates to the OS of the information terminals used to use the Service. The Company does not guarantee that any such malfunctions will be resolved by modifying the program, etc., that the Company makes.
    5. Users acknowledge in advance that use of all or part of this Service may be restricted due to changes in the terms of use and operating policies of service stores such as the App Store and Google Play.
    6. The Company shall not be liable for any direct or indirect damages, lost profits, or any other damages incurred by the User or a third party as a result of the User's use of the Service.
    7. The User shall resolve any disputes that arise between the User and a third party at the User's own responsibility and expense, and the Company shall not be liable for any such disputes, even if the User has been notified of the possibility of such disputes in advance. If the User causes damage to the Company as a result of a dispute with a third party, the User shall compensate for such damages.
    8. Users shall use the Service at their own risk, and shall indemnify the Company for any damages arising from the User's use of the Service or any breach of these Terms and Conditions by the User, as well as any lawsuits, claims, or other disputes from third parties, and understand and agree that the Company shall not be liable for such damages.
  • Article 13 Prohibition of Transfer of Rights

    1. Users may not transfer their status under these Terms and Conditions, or all or part of their rights or obligations under these Terms and Conditions, or their account, to a third party without our prior written consent.
    2. We may, at our discretion, transfer all or part of the Service to a third party, in which case all of the User's rights relating to the Service, including User's registration information, will be transferred to the transferee within the scope of the transferred rights.
  • Article 14 Severability

    Even if any provision or part of any provision of these Terms and Conditions is determined to be invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of these Terms and Conditions and the remaining part of the provision that is determined to be invalid or unenforceable shall continue to be in full force and effect.

    Users may contact or inquire about the Service to the Company through the inquiry form provided on the Service or in an appropriate location on the Site, or by a method separately designated by the Company.

  • Article 16 Governing Law and Jurisdiction

    1. These Terms and Conditions and the relationship between the User and our company shall be governed by Japanese law.
    2. In the unlikely event of a dispute, the Tokyo District Court or the Tokyo Summary Court shall be the court of first exclusive jurisdiction.
  • Article 17 Exclusion of Anti-Social Forces

    1. The User represents and warrants that the User is not currently a member of an organized crime group, a member of an organized crime group, a quasi-member of an organized crime group, a company related to an organized crime group, a corporate racketeer, a social activist, a criminal organization specializing in intellectual crimes, or any other person equivalent thereto (hereinafter referred to as "Organized Crime Group Members, etc."), and that the User will not fall into any of the following categories in the future:
      (A) Having a relationship with an organization or other person equivalent thereto that is deemed to control or be substantially involved in the management of an organized crime group member, etc.
      (B) Having a relationship that is deemed to be an unfair use of an organized crime group member, etc., for the purpose of obtaining wrongful gain for oneself or a third party or for the purpose of causing damage to a third party, or
      (C) Having a relationship that is deemed to be involved in providing funds, etc., or convenience to an organized crime group member, etc.
    2. The User undertakes not to engage in any of the following acts, either by himself or through a third party:
      (A) violent demands;
      (B) unreasonable demands that exceed legal responsibility;
      (C) threatening behavior or the use of violence in relation to transactions;
      (D) spreading rumors, using fraudulent means or using force to damage the Company's credibility or interfere with the Company's business;
      (E) any other acts equivalent to those listed above.
